Mir\u00ebpo, duke pasur parasysh se sipas Ligjit p\u00ebr Parandalimin e Korrupsionit dhe Konfliktit t\u00eb Interesit t\u00eb vitit 2019 (\u201eGazeta Zyrtare e RM\u201c, num\u00ebr 12\/2019) KSHKP nuk jep m\u00eb opinione p\u00ebr k\u00ebrkesat e dor\u00ebzuara n\u00eb lidhje me m\u00ebnyr\u00ebn e veprimit gjat\u00eb periudh\u00ebs zgjedhore, Akademia vepron sipas praktik\u00ebs s\u00eb vendosur m\u00eb par\u00eb nga KSHKP.<\/p>\n<p style=\"text-align: justify;\">Gjegj\u00ebsisht, n\u00eb vitin 2017, n\u00eb procedur\u00ebn e pranimit t\u00eb gjenerat\u00ebs s\u00eb VI n\u00eb trajnimin fillestar, Akademia ishte n\u00eb nj\u00eb situat\u00eb t\u00eb ngjashme (shpallja publike p\u00ebr pranimin e gjenerat\u00ebs s\u00eb VI zgjati rreth dy vjet p\u00ebr shkak t\u00eb kompleksitetit t\u00eb provimit i cili kryhet n\u00eb disa faza dhe p\u00ebrfundimi i procedur\u00ebs gjyq\u00ebsore administrative). Akademia e publikoi konkursin n\u00eb at\u00eb koh\u00eb n\u00eb vitin 2015, nd\u00ebrsa d\u00ebgjuesit n\u00ebnshkruan kontratat e pun\u00ebs m\u00eb 01.03.2017. Duke qen\u00eb se gjat\u00eb asaj periudhe shteti ishte n\u00eb nj\u00eb proces zgjedhor, Akademia iu drejtua KSHKP me k\u00ebrkes\u00eb p\u00ebr opinion n\u00ebse ka ndonj\u00eb penges\u00eb ligjore p\u00ebr zbatimin e pun\u00ebsimit me afat t\u00eb caktuar (p\u00ebr koh\u00ebzgjatjen e trajnimit fillestar dhe deri n\u00eb p\u00ebrzgjedhjen e kandidatit p\u00ebr gjykat\u00ebs apo prokuror\u00eb publik).<\/p>\n<p style=\"text-align: justify;\">KSHKP ka dor\u00ebzuar n\u00eb Akademi opinionin num\u00ebr 12-1637\/2 nga 24.02.2017, ku thuhet se: ,,\u2026. <em>nuk ka asnj\u00eb penges\u00eb ligjore p\u00ebr zbatimin e procedur\u00ebs s\u00eb nisur p\u00ebr pun\u00ebsimin me afat t\u00eb caktuar t\u00eb 37 <\/em><em>d\u00ebgjuesve<\/em> <em>n\u00eb<\/em><em> trajnim<\/em><em>in<\/em><em> fillestar n\u00eb <\/em><em>AGJPP <\/em><em>&#8230; n\u00ebse p\u00ebr k\u00ebto pun\u00ebsime \u00ebsht\u00eb siguruar aprovimi financiar p\u00ebr vitin 2017 dhe jan\u00eb pun\u00ebsime n\u00eb raste <\/em><em>t\u00eb shpejta<\/em><em> dhe urgjente<\/em>\u201d.<\/p>\n<p style=\"text-align: justify;\">P\u00ebr t\u00eb v\u00ebrtetuar ligjshm\u00ebrin\u00eb e procedur\u00ebs, Inspektorati Shtet\u00ebror i Pun\u00ebs (ISHP), duke vepruar sipas Konkluzionit t\u00eb Qeveris\u00eb, ka kryer nj\u00eb inspektim t\u00eb jasht\u00ebzakonsh\u00ebm lidhur me k\u00ebto pun\u00ebsime, gjat\u00eb t\u00eb cilit ka inspektuar t\u00eb gjith\u00eb dokumentacionin q\u00eb nga shpallja e konkursit deri n\u00eb regjistrimin e d\u00ebgjuesve, pas s\u00eb cil\u00ebs \u00ebsht\u00eb konstatuar se pas k\u00ebqyrjes s\u00eb p\u00ebrgjithshme t\u00eb dokumentacionit t\u00eb nevojsh\u00ebm \u00ebsht\u00eb p\u00ebrcaktuar se p\u00ebr t\u00eb gjitha veprimet e nd\u00ebrmarra p\u00ebr realizimin e k\u00ebtyre pun\u00ebsimeve ka mendime nga KSHPK (num\u00ebr 12-467\/2 nga 23.01.2017 dhe num\u00ebr 12-1637\/2 nga 24.02.2017) dhe p\u00eblqimet nga Ministria e Financave si dhe rip\u00ebrt\u00ebritja e t\u00eb nj\u00ebjt\u00ebs p\u00ebr shkak t\u00eb zgjatjes s\u00eb procedur\u00ebs, k\u00ebshtu q\u00eb Inspektorati Shtet\u00ebror i Pun\u00ebs nuk ka konstatuar shkelje n\u00eb regjistrimin e 37 kandidat\u00ebve n\u00eb Agjencin\u00eb e pun\u00ebsimit t\u00eb RMV.<\/p>\n<p style=\"text-align: justify;\">N\u00eb rastin konkret, \u00ebsht\u00eb nj\u00eb situat\u00eb e ngjashme si n\u00eb vitin 2017, me dallimin se tani, edhe me respektimin m\u00eb t\u00eb rrept\u00eb t\u00eb Dinamik\u00ebs s\u00eb re kohore, nuk ka absolutisht asnj\u00eb mund\u00ebsi p\u00ebr t\u00eb arritur n\u00eb faz\u00ebn e krijimit t\u00eb nj\u00eb marr\u00ebdh\u00ebnie pune me d\u00ebgjuesit gjat\u00eb periudh\u00ebs zgjedhore.<\/p>\n<p style=\"text-align: justify;\">N\u00eb vijim, ne ofrojm\u00eb nj\u00eb p\u00ebrmbledhje t\u00eb shkurt\u00ebr t\u00eb fazave t\u00eb provimit aktual pranues p\u00ebr d\u00ebgjuesit e gjenerat\u00ebs s\u00eb IX n\u00eb trajnimin fillestar:<\/p>\n<ul style=\"text-align: justify;\">\n<li>njoftimi publik p\u00ebr pranimin e 130 d\u00ebgjuesve \u00ebsht\u00eb publikuar n\u00eb janar 2023;<\/li>\n<li>dh\u00ebnia e testit p\u00ebr njohjen e nj\u00ebrit nga tre gjuh\u00ebve m\u00eb t\u00eb p\u00ebrdorura n\u00eb BE (anglisht, fr\u00ebngjisht ose gjermanisht) n\u00eb maj 2023;<\/li>\n<li>nd\u00ebrprerja e procedur\u00ebs p\u00ebr shkak t\u00eb miratimit t\u00eb Ligjit t\u00eb ri p\u00ebr Akademin\u00eb p\u00ebr Gjykat\u00ebs dhe Prokuror\u00eb Publik (\u201eGazeta Zyrtare e RMV\u201d, nr. 129\/2023) i cili parashikonte ndryshimin e rendit dhe m\u00ebnyr\u00ebs s\u00eb dh\u00ebnies s\u00eb pjes\u00ebve t\u00eb provimit t\u00eb pranimit;<\/li>\n<li>pas kryerjes s\u00eb testit psikologjik dhe testit t\u00eb integritetit n\u00eb tetor dhe n\u00ebntor 2023, Akademia u p\u00ebrball me nj\u00eb penges\u00eb t\u00eb re p\u00ebr dh\u00ebnien e testit t\u00eb kualifikimit \u2013 kontrata p\u00ebr prokurimin publik n\u00eb grup p\u00ebr kryerjen e sh\u00ebrbimeve p\u00ebr mir\u00ebmbajtjen e softuer\u00ebve p\u00ebr dh\u00ebnien e provimeve n\u00eb institucionet shtet\u00ebrore kishte skaduar. Akademia nuk ka pasur mund\u00ebsi q\u00eb provimin ta zhvilloj\u00eb n\u00eb m\u00ebnyr\u00eb elektronike, pas s\u00eb cil\u00ebs jan\u00eb iniciuar ndryshime ligjore n\u00eb drejtim t\u00eb mund\u00ebsimit t\u00eb dh\u00ebnies n\u00eb let\u00ebr t\u00eb testit t\u00eb kualifikimit;<\/li>\n<li>n\u00eb mars t\u00eb vitit 2024 u miratuan ndryshimet n\u00eb Ligjin p\u00ebr Akademin\u00eb p\u00ebr Gjykat\u00ebs dhe Prokuror\u00eb Publik (\u201eGazeta Zyrtare e RMV\u201d, num\u00ebr 53\/24), dhe pas hyrjes s\u00eb tyre n\u00eb fuqi u miratua Vendimi statutor p\u00ebr plot\u00ebsimin e Statutit t\u00eb Akademis\u00eb p\u00ebr Gjykat\u00ebs dhe Prokuror\u00eb Publik \u201cPavell Shatev&#8221; (\u201eGazeta Zyrtare e RMV\u201d, num\u00ebr 62\/24) dhe Rregullorja p\u00ebr plot\u00ebsimin e Rregullores p\u00ebr dh\u00ebnien e provimit pranues n\u00eb Akademi;<\/li>\n<li>n\u00eb mars 2024, Komisioni p\u00ebr provimin pranues p\u00ebrcaktoi nj\u00eb Dinamik\u00eb t\u00eb re kohore p\u00ebr zbatimin e pjes\u00ebs s\u00eb m\u00ebtejshme t\u00eb provimit pranues, sipas s\u00eb cil\u00ebs testi i kualifikimit \u00ebsht\u00eb planifikuar t\u00eb zhvillohet n\u00eb periudh\u00ebn nga 1 deri m\u00eb 4 prill 2024.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Nga e gjitha e th\u00ebn\u00eb m\u00eb sip\u00ebr, \u00ebsht\u00eb thelb\u00ebsore t\u00eb kihet parasysh se n\u00eb k\u00ebt\u00eb rast nuk b\u00ebhet fjal\u00eb p\u00ebr krijimin e nj\u00eb marr\u00ebdh\u00ebnie pune, por p\u00ebr zbatimin e fazave t\u00eb provimit pranues n\u00eb kuad\u00ebr t\u00eb trajnimit fillestar.<\/p>\n<p style=\"text-align: justify;\">Institucionet t\u00eb cilat n\u00eb kuad\u00ebr t\u00eb veprimtaris\u00eb s\u00eb tyre zhvillojn\u00eb provime si provimi p\u00ebr noterin\u00eb, provimi i jurisprudenc\u00ebs, provimi p\u00ebr p\u00ebrmbarues, provimet e fakulteteve dhe t\u00eb tjera, vazhdojn\u00eb me aktivitetet e tyre t\u00eb rregullta edhe gjat\u00eb periudh\u00ebs zgjedhore. Nga Dinamika e re kohore e publikuar, e cila ishte arsyeja e denoncimit t\u00eb dor\u00ebzuar n\u00eb KSHPK, mund t\u00eb shihni aktivitetet e m\u00ebtejshme t\u00eb Akademis\u00eb p\u00ebr realizimin e pjes\u00ebs s\u00eb m\u00ebtejshme t\u00eb provimit pranues, si dhe n\u00eb njoftimin e Komisionit p\u00ebr provimin pranues t\u00eb Akademis\u00eb e publikuar n\u00eb faqen e Akademis\u00eb m\u00eb 18.03.2024, thuhet qart\u00eb se periudha m\u00eb e hershme n\u00eb t\u00eb cil\u00ebn kandidat\u00ebt mund t\u00eb pritet t\u00eb lidhin kontrat\u00eb pune me Akademin\u00eb \u00ebsht\u00eb muaji shtator. P\u00ebr m\u00eb tep\u00ebr, thjesht vendosja e nj\u00eb marr\u00ebdh\u00ebnie pune me afat t\u00eb caktuar me Akademin\u00eb nuk garanton marrjen e pozicionit t\u00eb gjykat\u00ebsit\/prokurorit publik. P\u00ebrkat\u00ebsisht, me marrjen e statusit t\u00eb d\u00ebgjuesit n\u00eb trajnimin fillestar n\u00eb Akademi, d\u00ebgjuesi krijon marr\u00ebdh\u00ebnie pune me afat t\u00eb caktuar me Akademin\u00eb p\u00ebr periudh\u00ebn e zhvillimit t\u00eb trajnimit fillestar deri n\u00eb p\u00ebrzgjedhjen p\u00ebr gjykat\u00ebs ose prokuror\u00eb publik. D\u00ebgjuesit, pas pranimit n\u00eb trajnimin fillestar, akoma vazhdojn\u00eb t\u00eb japin provime n\u00eb kuad\u00ebr t\u00eb m\u00ebsimdh\u00ebnies teorike dhe n\u00ebse e kalojn\u00eb me sukses, ndjekin m\u00ebsimin praktik, i cili gjithashtu vler\u00ebsohet. N\u00eb fund, d\u00ebgjuesit q\u00eb kan\u00eb kaluar me sukses m\u00ebsimin teorik dhe praktik i n\u00ebnshtrohen provimit p\u00ebrfundimtar.
